Welcome to Bactosure. We license use of, and provide access to and support of, our proprietary microbiological testing system that helps to detect pathogens in drinking water. Bactosure is operated by Bactosure Solutions Limited, a limited liability company registered in New Zealand, with its registered office at Suite B001, 32 Salamanca Road, Kelburn, Wellington, New Zealand (Bactosure, we, us or our).

In this Privacy Policy, any person who accesses or uses the Bactosure solution or we provide services to (together, the Services) is referred to as you or your.

This Privacy Policy sets out our and your, rights and obligations in relation to personal information you provide (or we otherwise gather) through your use of the Services. Personal information means any information about an individual where that information can be linked to (or in conjunction with other data can be linked to) an identifiable individual. We will handle all personal information we hold as a result of your use of the Services in accordance with this Privacy Policy and applicable privacy laws.

Please read this Privacy Policy carefully before subscribing to, accessing, or using the Services. By subscribing to, accessing, or using the Services you agree to follow and be bound by our Subscription and Service Terms (Terms). If you do not agree to all the Terms, you must not subscribe to, access, or use the Services.

Except as set out in this Privacy Policy, capitalised terms used in this Privacy Policy have the same meanings as set out in the Terms. This Privacy Policy may be varied by us at any time.  The variation will be effective upon the posting of modified terms on the Bactosure Website (Website) or us otherwise notifying you in writing (including by email). The home page of the Website will contain a link to this policy and set out when it was last updated. When we update the Privacy Policy on the Website, we will amend the “last updated date” set out there adjacent to the link to the policy. You should ensure that you have read and understood the most recent Privacy Policy posted on the Website, or otherwise notified to you.

  1. Collection

    1. We may gather two types of information about you from your access to and use of the Services:
      1. personal information and any other information, provided by you, both at the time of subscribing for the Services and also when you use the Services, including name, address, email address, contact details, location data and IP address; and
      2. aggregate information generated by our systems that relates to your use of the Services or the Website but do not relate to you personally (if we combine or connect aggregate information with your personal information so that it can directly or indirectly identify you, we will treat the combined data as personal information which will be used in accordance with this Privacy Policy).
    2. We may receive personal information about you from various third parties including analytics providers (such as Google) and/or financial and transaction information from our payment processors (excluding any credit card or bank account details).
    3. If you fail to provide us with personal information that we request, then this may result in certain Services (or certain aspects of Services) not being available to you.
  2. Use

    1. We may use the personal information that we gather from you:
      1. to provide you with (and assist you with using) the Services;
      2. to enhance the delivery of the Services to you; 
      3. to contact you in relation to your use of the Services;
      4. to notify you of any changes to the Services;
      5. to allow us to process payments in relation to the Services;
      6. to monitor, develop and improve our products, the Services and the Website;
      7. for marketing purposes provided that we receive any required consent from you for this (as set out below in clause 2.2);
      8. to comply with our legal obligations; and
      9. for any other use that you authorise.
    2. We will obtain your consent before sending marketing communications to you. Where you have given your consent, you have the right to withdraw consent to marketing communications by unsubscribing through the unsubscribe link in the email or updating your communication preferences through the Website. If you elect not to receive communications or ask to be removed from a mailing list, we may still send you communications where it is necessary for the provision of the Services or to provide you with details of the Services and payment related matters.
  3. Disclosure of information

    1. We will only share personal information with other organisations or individuals in the following limited circumstances:
      1. Where we engage the following categories of third parties to perform services on our behalf or assist in providing the Services:
        1. hosting and storage providers;
        2. maintenance, support and backup providers;
        3. technical support providers, to help improve the Services or Website;
        4. payment processors, financial and credit card institutions, assistance with debt recovery;
        5. customer support providers; and
        6. marketing and research agencies,
    2. we will ensure that these parties will be our data processors and agree to use personal information only as required to perform their functions (and not for other purposes) under our instructions, and to process the personal information in accordance with applicable privacy laws.
      1. We may disclose your personal information:
        1. to satisfy any applicable law, regulation, legal process or government request (for example, where we are required to report any positive detection of pathogens in drinking water to the relevant authority);
        2. for the prevention of fraud or other illegal activities;
        3. related to suspected or actual violations of our Terms;
        4. to third parties as part of assigning a debt relating to payments that you have not made in accordance with our Terms; and/or
        5. to safeguard our rights and the rights and safety of others.
      2. Where you give us your express consent to share your personal information with third-party service providers to assist in identifying and resolving sources of water contamination.
  4. Cookies and tracking

    1. We may use cookie files and similar tracking technologies such as resettable device identifiers or advertising identifiers from computers or other devices used to access the Website, containing information that can identify the computer you are working from.
    2. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. We use the following types of cookies and identifiers:
      1. Essential cookies:  these are strictly necessary to provide you with the Services available through the Website and to use some of the Website features.
      2. Performance and Functionality Cookies: to enhance the performance and functionality of the Website, but are not essential to its use.
      3. Session and Preference Cookies: to keep you logged in during your visit, remember your preferred settings and enable forms to be prepopulated with your information to aid in the convenience of the use of the Website.
      4. Security Cookies: for security purposes to protect your use of the Website.
      5. Advertising Cookies: to track your response to ads and emails.

We do not control the practices of content providers, advertisers, partners and other third parties connected with the Services and to whom you provide personal information whilst using the Services. The Website and Services may contain links to other sites, which may not follow the same privacy policies that we adopt. We recommend that you check any relevant privacy policies before providing your personal information to any third party.
  6. Analytics

    1. We use software and systems which analyse information provided through the Website and Services on an aggregated basis (Analytics). The Analytics are collected and aggregated so you cannot be identified personally and no personal information is stored about you through these Analytics. We may use the Analytics to enhance the delivery of the Services to you. We may also provide the Analytics to other service providers or entities that are involved in the delivery or testing of drinking water. This is done to ensure that microbiological issues in water bodies and infrastructure can be detected and the access to clean water is promoted in the communities where we provide Services.
  7. Security

    1. We have put in place security measures that seek to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. As no data transmission over the internet can be guaranteed to be completely secure, we cannot ensure the security of any information you transmit or receive through Website and/or Services. While we take precautions to minimise the related risks, these activities are conducted at your own risk.
  8. Holding, correcting and updating

    1. We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for. Any personal information about you that we gather will be held by:
      1. us, at our premises in New Zealand; and
      2. our providers, described in section 3, who hold information as our agent.
    2. You have rights of access to and correction of personal information that we hold about you. We offer the ability for you to correct or change the personal information collected or gathered about you at any time and as often as necessary. You are able to correct or change the personal information we hold about you (excluding any factual data, such as test results) through the Services. If you have any questions about how the Website or Services work or regarding this Privacy Policy, or if you wish to correct information that we hold about you that is not correct and that you are unable to change yourself  please contact us by sending an email to [email protected].  
    3. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who doesn’t have a right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

  9. International Transfers


    1. Where our providers are based outside of the country you live in, the processing of your personal information will involve a transfer of information outside the country you live in. The personal information that we collect may therefore be transferred to, and stored in countries, which have less strict, or no data protection laws, compared to those where you reside. Where we transfer your personal information out of the country you live in, we will take reasonable necessary steps to ensure that safeguards are in place to protect your personal information.
